(a) Acquisition authority for experimental or test purposes under 10 U.S.C. 2373 is delegated from AFMC/PK to the Senior Center Contracting Officials (SCCO). This acquisition authority was originally delegated by the Acting Secretary of the Air Force (SAF Memo, Delegation of Acquisition Authority for Experimental or Test Purposes) to AFMC/CC and from AFMC/CC to AFMC/PK (AFMC/CC Memo, same subject, 28 Sep 1998).
Purchases under 10 U.S.C. 2373 may be made inside or outside the US and by contract or otherwise. Chapter 137 of Title 10 applies only when purchases are made in quantity. This authority may be further redelegated, in writing, and implemented as appropriate and necessary subject to the following:
(1) Specific justification for each use of this authority must be documented in a determination and findings (D&F), signed by the contracting officer, and included in the contract file. The D&F must include, as a minimum, a description of the item to be purchased, a description of the method of test/experimentation, the quantity to be tested, and a definitive statement that use of the authority at 10 U.S.C. 2373 is determined to be appropriate for the acquisition.
(2) The D&F for those actions utilizing this authority that exceed $1.5M must be approved by the SCCO prior to award.
