(b) The requirements office initiating an acquisition is responsible for determining whether recovered materials should be included in the specifications.
(c) Requirements offices may purchase EPA designated items containing other than recovered materials only if one of the exemptions listed in FAR 23.405(c) applies. If the requirements office determines to acquire EPA designated items that do not contain recovered materials, the requirements office shall prepare a written justification. This justification shall be submitted to the contracting officer for approval. If the contracting officer approves the justification, he/she shall return a copy of the approved justification to the requirements office, and maintain the original in the contract file. The requirements office shall send a copy of the approved justification to the Office of Facilities Management Services, Domestic Environmental and Safety Division (A/OPR/FMS).
