I219 52.245-9G07 GOVERNMENT FURNISHED PROPERTY DSCR (APR 2005)
AND PROVISION

(a) Government Property Clause: FAR Clause 52.245-2,
Government Property (Fixed Price Contracts) (MAY 2004), is
incorporated herein by reference. The Government will furnish the
material specified in paragraph (f) below. All other property and
material will be furnished by the Contractor. The GFP Monitor,
Strategic Material Sourcing Group, ATTN: DSCR-FAGD, Telephone
(804) 279-4642, will be notified when Government Furnished Material
(GFM) described herein is not received by the Contractor within a
reasonable time.
(b) Ownership of GFM in Overruns: Any quantities of items
manufactured and delivered under this contract in excess of
quantities specified herein permitted by the Variation in Quantity
Clause, if any, are the sole property of the Government and no
compensation shall be allowed the Contractor therefor.
(c) Material Required in Excess of Unit Allowance: If the
Contractor requires material in excess of the unit allowance
specified in paragraph (f) below, such additional material will
be furnished by the Government. However, the Contractor must
bear the cost of such excess materials, including transportation
charges therefor, required in the performance of the contract.
The price charged the Contractor for such excess materials will
be the price specified in paragraph (f) below for the type of
material in question or the standard Government price therefore
at the time of shipment, whichever is higher. The cost of such
excess material will be withheld by the Government from payment
due to the Contractor, unless the Contractor makes other
arrangements with the Contracting Officer for payment.
(d) Transporting of GFM: The Government will bear the cost
of transporting the GFM described herein to the plant as identified
in this paragraph. Shipments will be in economical transportation
quantities via the most cost favorable mode and carrier selected
by the Government. Such costs will be used in the evaluation of
the offer. Therefore, offerors must indicate in the space below the
name and address of the plant where the GFM will be utilized. If
such is not so indicated, the Government will assume, and evaluate
offers on the assumption, that the GFM will be delivered to the
plant specified by the offeror in paragraph (b) of Clause 52.247-9G17
(Sec K), Production Facilities. If no plant is indicated in the offer,
the offer will be evaluated on the basis of delivery to the
Contractor's business address indicated in the offer. If the
offeror used a shipping point other than that which has been used
by the Government as a basis for the evaluation of offers, any
increase of transportation costs shall be borne by the Contractor
and any savings shall revert to the Government.
PLANT
CITY AND STATE
(e) Contractor's Receipt for GFM: Concurrently with each
shipment of GFM, the Government will furnish the Contractor with
shipping documents setting forth the exact yardage of cloth or
quantity of other property furnished. Within five days after
receiving GFM, the Contractor will acknowledge on the shipping
document receipt of said GFM and return said document to the
Defense Supply Center Richmond, 8000 Jefferson Davis Highway,
ATTN: DSCR-Strategic Material Sourcing Group, DSCR-FAGD, Richmond,
Virginia 23297-5862.
The Government reserves the right to suspend further shipments
of property until receipts for GFM have been executed as aforesaid.
Notwithstanding any other contract provision, delays by the
Contractor caused by suspension of GFM shipments in such cases
shall not be an excusable cause by delay within the meaning of
the contract.
(f) Data on GFM to be Furnished and Delivery Schedule:
(1) The delivery Schedule contained herein is based on
the assumption that the initial delivery of GFM will be made to the
Contractor within forty-five (45) days after award. If this assumption
is not realized, the Contracting Officer shall upon timely written
request made by the Contractor, make an equitable adjustment in
accordance with the Government Property Clause.
(2) The Government will furnish the materials for use in
the performance of the resulting contract in the quantity required,
based on the unit allowance specified as follows:
