I33A 52.209-9G02 LUCAS WESTERN - BOA DSCR (JAN 1996)
ALTERNATE I
This Basic Ordering Agreement (BOA) is being entered
into solely because of the extreme urgency in obtaining
critical parts of which Lucas Western is the sole source.
It is being agreed to based on Lucas Western's certification
that the parts covered by this agreement have met all the
inspection and certification requirements referenced in
this BOA and/or any delivery order issued hereunder.
This BOA and/or any delivery order issued hereunder are
not to be interpreted as a ratification by DSCR or any
governmental entity of the integrity of the parts covered
by this BOA or any delivery order issued hereunder, nor
as a contractual or legal waiver by the government relating
to any matter involving the production of AMADs by Lucas
Western, or the production of other parts for DSCR at the
City of Industry or Park City facilities. This BOA and/or
any delivery order issued hereunder has no effect on the
Government's position with respect to any possible past
contractual violations by Lucas Western, and it in no way
waives or limits any criminal, civil, or administrative
actions or remedies which the government may pursue against
Lucas Western. To the extent that this BOA and/or any
delivery order issued hereunder includes inspection and/or
acceptance and/or other provisions that are different from
inspection and/or acceptance and/or other provisions included
in prior contracts, BOAs or BOA orders, or to the extent such
procedures are utilized by the Government differently from in
previous contracts or BOA orders, any such change is solely
the result of DSCR's pressing need to obtain essential parts
from Lucas Western without impairing readiness. To the extent
there are changes in inspection and/or acceptance provisions or
procedures, such changes in no way indicate that any prior
provisions or procedures were in any way improper, immaterial
or beyond the Government's authority.
