I237E 52.246-9G33 MISDIRECTED SHIPMENTS DSCR (JAN 1996)

Notwithstanding any other clause or provision of the contract,
the Government may reship any misdirected shipments to the correct
"SHIP TO" address, without prior Contractor notification, and will
require an equitable adjustment in the contract price to cover the
full amount of the reshipment charges. A misdirected shipment is
one which was received at any destination other than that specified
in the contract. If so reshipped, the Government additionally would
require, also without prior Contractor notification, a equitable
adjustment in the contract price to cover labor and material costs
for correction of any packaging, packing, and marking deficiencies
when those actual corrective costs are less than $250. However,
there is no monetary limitation on recovery of costs incurred by
the Government for any correction of repackaging, repacking, and
remarking deficiencies regarding hazardous supplies.
