AND                  PROPERTY (LOANED) PROVISIONS

    (a)  Government Property Clause:  FAR Clause 52.245-2, 
Government Property (Fixed Price Contracts) (MAY 2004), 
is incorporated herein by reference.  The Government will furnish 
the property specified in (c)(2) below for use in the performance 
of this contract.  All other property and material will be furnished 
by the Contractor.  If GFP is not delivered to the Contractor by 
the required time, the Contractor should contact the GFP Monitor, 
Strategic Material Sourcing Group, ATTN:  DSCR-FAGD, Phone
(804) 279-4642.

    (b)  Transporting GFP:  The Government will bear the cost 
of transporting the GFP described herein to the plant as identified 
in this paragraph.  Such costs will be used in the evaluation of the 
offer.  Therefore, offerors must indicate in the space below the 
name and address of the plant where the GFP will be utilized.  If 
such is not so indicated, the Government will assume, and evaluate 
offers on the assumption, that the GFP will be delivered to the 
plant specified by the offeror in paragraph (b) of Clause 
52.247-9G17 (Sec K), Production Facilities.  If no plant is 
indicated in the offer, the offer will be evaluated on the basis of 
delivery to the Contractor's business address indicated in the offer.
If the offeror uses a shipping point other than that which has 
been used by the Government as a basis for the evaluation of 
offers, any increase of transportation costs shall be borne by 
the Contractor and any savings shall revert to the Government.

    (c)  Data on GFP to be Furnished and Delivery Schedule:

         (1)  The delivery Schedule contained in the solicitation 
is based on the assumption that delivery of the GFP will be made to 
the Contractor within forty-five (45) days after award.  If the GFP 
is not delivered within this time, the Contracting Officer shall, 
upon timely written request made by the Contractor, make an equitable 
adjustment in accordance with the Government Property Clause.

         (2)  At no cost to the Contractor, except as may apply per 
paragraph (b) of this Clause, the Government will furnish the GFP for 
use in the performance of the resulting contract as follows:

    (d)  Contractor's Receipt for GFP:  With each shipment of GFP the 
Government will furnish the Contractor with shipping documents setting 
forth the exact quantity of GFP furnished.  Within five days after 
receiving GFP, the Contractor will acknowledge, on the shipping document,
receipt of said GFP and return said document to Defense Supply Center 
Richmond, 8000 Jefferson Davis Highway, ATTN:  Strategic Material
Sourcing Group, DSCR-FAGD, Richmond, VA 23297-5862.

    (e)  Inspection of GFP:  The Contractor shall arrange with the 
Contract Administration Office (CAO) for inspection of the GFP 
within thirty days after its receipt.  Damaged or defective 
property shall be reported promptly.  The Contractor will also 
have a confirming inspection made by the carrier's representative 
if damage appears attributable to the carrier.

    (f)  Return of GFP to the Government:

         (1)  When the GFP identified in (c)(2) above is no longer 
required for use by the Contractor or Government Quality Assurance 
Representative (QAR), but no later than completion of delivery of 
the end items or termination of this contract, the Contractor 
shall deliver to the Government, as specified in the remainder of 
this paragraph (f), all of said GFP, unless directed otherwise by 
the Contracting Officer.

         (2)  The Contractor shall notify the CAO to arrange for 
inspection by the Government QAR of the condition of the GFP before 
it is packed for return to the Government.  The Contractor shall be 
responsible for all repairs or replacements necessary to restore the 
GFP to its condition at time of receipt, excluding reasonable 
wear and tear.  The final marking and shipping instruction for 
returning GFP shall be obtained from the Contracting Officer through 
the CAO.

         (3)  The Contractor shall prepare, package, pack, and mark 
such property for shipment in accordance with ASTM D3951 f.o.b. origin 
at plant where used.
