DSCR H14D: CHANGES RESULTING FROM STATEMENT OF WORK REQUIREMENTS

H43F30               REQUIREMENTS

    In the event that a specific paragraph of Section C, 
(e.g., Gears of Motors), is invoked (and the parties agree 
that it is necessary to replace the specific item) and the 
words "the additional cost shall be borne by the Government" 
are being interpreted or applied, the Contractor will be 
required to submit a proposal indicating the price of the 
item (demonstrating competition when necessary), material 
handling cost, labor cost, lead time to receive the item etc.  
The Government may provide the item to the Contractor; or 
the parties will negotiate a fair and reasonable price to be 
paid by the Government to the Contractor for purchase of the 
item.  When the item is to be purchased by the Contractor, the 
Government will, at no cost to the Contractor, extend the 
performance time of the contract to compensate for a reasonable 
lead time for the Contractor to receive the item.  The Government 
will not bear any costs associated with the Contractor's delayed 
performance, unless said delay is due to unreasonable Government 
delay.  Any resultant modification will be on a firm-fixed price 
basis covered under the Changes Clause, FAR 52.243-1.
